Are OTT Platforms Beyond Legal Boundaries!!!

Mary Anne Charity Trust, on the occasion of World No tobacco day is releasing the report on Monitoring Tobacco control compliance on Over the Top (OTT Platforms) during the period 1st September 2023 to 31st March 2024.

An OTT (Over the Top) platform is a streaming service that uses internet to deliver the customized content, bypassing traditional cable or satellite channels, DTH and television. Over-The-Top (OTT) platforms flourished during the outbreak of COVID’19. OTT platforms have changed the way we consume entertainment. It offers a vast library of films, web-series, TV show allowing the users to stream content on demand at anytime, anywhere within the reach of fingers. It has gained popularity for their convenience, variety of content and personalized recommendations among the everyone especially the youth and children.

 

 

 


 

As of 2024, the OTT (Over-The-Top) industry in India has experienced tremendous growth. With the increasing number of internet users and improved connectivity across the country, the demand for OTT platforms has skyrocketed. As per reports, there are 50 crore OTT subscribers in India until 2023. According to Ministry of Information and Broadcasting there are 57 types of OTT platforms available in India until January 2024.

 

At this juncture, government has a specific order to monitor the violations in OTT platforms called GSR 400(E). Even though there is a law, the OTT platforms are not abiding this law and follow their own guidelines in streaming. Hence in order to curb the violations the law has to be made strict and stringent actions has to be penalised for the ones who does not follow. The report by MACT will act as a supporting document to present the current status in OTT platforms in terms of the violations and the action taken against each of the violation by these OTT platform authorities. Since they don’t have strict laws, OTT platform act as a place to showcase any of the banned tobacco products like hookah,   

e-cigarette usage and also many other child rights violations through the media. So on this World no tobacco day we are releasing this report to bring light over this issue.
